Introduction to court litigation

In this discussion you will define personal jurisdiction for a corporation and explain how personal jurisdiction is established.
Fact Pattern
Five years ago Monica Geller opened up a coffee shop, Locals’ Coffee, in New York City. Locals’ Coffee was a big hit among the locals, and Monica decided to expand her business by opening more coffee shops. Each year, Monica opened a new location—each in New York. Business was booming. Locals’ Coffee became so popular that a lot of tourists from all over the United States started visiting Monica’s shops. Knowing she had many tourists coming to her stores, Monica started selling bags of coffee beans so her clients could enjoy her coffee at home as well.
One day, Ross Geller visited Locals’ Coffee because he had read great reviews about the coffee shop on Yelp. Ross loved the coffee so much that he bought 20 bags of coffee (worth $400) from Locals’ Coffee so he could enjoy the coffee back at his home in New Jersey. Several weeks later, Ross opened a bag of Locals’ Coffee only to find it was filled with pebbles. He immediately filed a lawsuit in New Jersey against Locals’ Coffee. The courthouse is one hour away from one of the store locations for Locals’ Coffee. Does New Jersey have personal jurisdiction over Locals’ Coffee? Locals’ Coffee is incorporated in New York and has its principal place of business in New York.

Section 8.3 of your reading details many of the changes that have taken effect to private insurance as a result of the Affordable Care Act (ACA). As you know, the Trump administration is working to repeal and replace the ACA in its entirety. This administration is also making interim changes to pieces of the ACA. See your online reading materials.
If you were part of this administration, what would you get rid of, modify, or implement? Please do at least one of the following:
Choose a provision of the ACA that you would modify or delete. If you would modify it, how? If you would delete it, why? What population would this impact the most? What impact would this change have on the private insurance industry as a whole and consumers of the products?Tell us what regulatory provision you would add to the private insurance framework. Why? What population would this impact the most? What impact would this change have on the private insurance industry as a whole and consumers of the products?Comment on a change made by the Trump Administration. What are the benefits and disadvantages of the provision as written under the Obama Administration in comparison to the Trump Administration? What does each version say about the policies of the different administrations?

using the IRAC method complete the assignment:
You are a business owner who recently started a marijuana business in Los Angeles, California.
As you know from the live session, recreational and medical marijuana is legal in California (i.e., under state law) but continues to be illegal under federal law. Specifically, Congress passed the Controlled Substances Act, which categorized marijuana as a Schedule 1 drug. Other Schedule 1 drugs include heroin and LSD. Further, Congress can regulate and restrict the intrastate (entirely within a state) consumption of marijuana via the Commerce Clause (See Gonzales v. Raich, 545 U.S. 1 (2005); more about the Commerce Clause in Week 7).
To build awareness, you decide to write a blog post (similar to the one provided in your reading this week) that will be circulated widely. The intended audience will be other business owners and employees working at marijuana businesses.
In your blog post, you will address the following:
1.Supremacy Clause and Preemption: Provide a detailed explanation of how these concepts apply to the issue of marijuana. [8 points]
2.Knowing that preemption is a possibility, identify and explain three steps a business owner should take to plan for a possible raid or shut down. In your explanation, provide why you would take the step and the relevant authority supporting that step. [6 points]
3.Knowing that marijuana is still illegal under federal law, explain why you think lawyers are hesitant to represent clients in this space? [3 points]
4.Ask your employees if they would be interested in petitioning the state bar to allow non-lawyers to render advice in this area. In other words, provide a persuasive explanation on whether marijuana business advice could be an area for non-lawyer participation. [3 points]
Remember that the format for this assignment is a blog post. Consider using an appealing title and sub-headings to organize the blog post. To support your writing, consider using elements of IRAC throughout.

Professor’s Question:
Many people forget that when it
comes to policing, police departments are like any other organization with bosses and employees. Patrol officers are usually at the bottom of the hierarchy even though they have a great amount of discretion and authority with the public out on the street. How important do you think it is for police departments to focus on
keeping their employees (officers) happy? What do you think happens in a department where the officers are generally unhappy?

Discussion Question:
What aspects of classical and behavioral management theories have contributed the most to today’s police organizations? What particular aspects should be discarded? Provide an example of why police managers must be aware of both systems and contingency theory and how these theories may help them to develop appropriate operating policies for their organization.
Your response is to be supported with at least one scholarly source (other than the assigned course text) as well as the course text. Students Response:
This weeks discussion post reviews the aspects of
classical and behavioral management theories that have contributed to todays police organizations, as well as
what certain aspects should be
discarded. To be able to apply each theory it is important to know and understad both of them first. To start with the classical theory which is
based on the thought that workers only have physical and economic needs. According to Villanova University (2021), “Unlike more modern workplace management theories, it does not take into account
social needs or job satisfaction.
Instead, classical management theory advocates aspecialization of labor, centralized leadership and decision.making, and profit maximization”(par. 1). Two aspects that stand out within classical theory are the centralized leadership and decision-making. The centralized leadership plays a major role within law enforcement as it allows one leader to be in charge of groups and pass
messages or orders down the line. This assists in avoiding conflicting thoughts about what should be done;furthermore, this intertwines with the
decision-making aspect as there are not multiple people conflitcing about making different decisions and
leaving room for disagreeing and arguments. Within the classical management theory there are three main concepts. These concepts are hierarchical structure, specialization and incentives. The hierarchical
structure allows for different levels of management from the top, middle, and lower levels within the chain of command. In law enforcement these would rank from highest to lowest:
Chiefs of Police, Lieutenants or
Captains, Sergeants, Detectives, and then Officers. Having a hierarchical structure allows for a solid chain of command and understanding the roles one plays within the criminal justice system. The next concept is specialization, this involves employees understanding their roles in certain areas and generally specializing in that area. For example, homicide detectives will specialize in
homicide cases and generally work those rather then a detective who specializes in white collar crime. The last concept involves incentives. The
classical theory belives that employees will be strongly motivated by financial rewards. Classical theory states that employees will tend to work harder and be more on task
when they are aware that they can be awarded incentives for the work they have done. Within law enforcement this concept can be a positive and a negative. Of course the positive would be officers remaing more on task and being diligent with their work, but a con may be if an officer has a set quota to meet for traffic stops for an incentive, then the officer may attempt to reach that number by making faulty traffic stops which can
then lead to larger issues. The next theory is behavioral management theory. The behavioral management
theory will focus on human relations within the work environment due to the human dimension of work where
it can often be called the human
relations movement (Lumen, 2019). A big part of behavioral theory involves working in big part of group power. A
big plus with this aspect is allowing others to also feel empowered and having a voice, but this can also lead to disagreements on certain decisions and depending on the situation there may not be time to argue whos point or idea is better. It is important for
police managers to be able to
understand each system as they can implement some positive techniques from each system into their own. Additionally,
understanding the theories along with managers understanding their group members can lead to many
positive results.
